Business owners must classify their workers as either Employees or Independent Contractors. The classification of a worker as an Independent Contractor is frequently appealing to the Owner because it saves the Owner money and means less administrative work. However, the classification is determined by law, not by the parties’ choice. This workshop covers the legal factors that determine the proper classification, identifying the three main categories of evidence that show whether a worker is an employee or an independent contractor. Businesses must weigh all these factors when determining whether a worker is an employee or independent contractor. (This is also sometimes called “WORKER MISCLASSIFICATION”)
