While the New York State Dept. of Health has terminated the designation of COVID-19 as an airborne infectious disease that presents a serious risk of harm to public health, as of March 17.
Under the HERO Act Employers are still required to have a workplace-exposure prevention plan, they are just no longer required to “activate” it. That means that health screening and social distancing are no longer mandatory. Other aspects of the HERO Act are still in place, and most Employers in New York City are still subject to the requirements of the Private Employer Vaccine Executive Order.
